1. About these terms
These terms apply to the Big Stakes website at bigstakespod.com, the Big Stakes podcast and videos, The Brief newsletter, and anything else we publish (together, the “Services”). The Services are run by the Big Stakes team in Sydney, Australia (“Big Stakes”, “we”, “us”).
By using the Services you agree to these terms and our privacy policy. If you don’t agree, please don’t use them.
2. General information, not advice
Everything in the Services is general information and commentary for education and entertainment. It does not take into account your objectives, financial situation or needs. It is not financial product advice, investment, legal, tax, accounting or other professional advice, and it is not a recommendation to buy, sell or hold any financial product, security or asset.
Big Stakes does not hold an Australian financial services licence. Before acting on anything you hear or read, consider whether it suits your circumstances, read any relevant disclosure documents and get advice from a licensed professional. Read our full disclaimer.
3. Opinions and interests
Hosts and guests speak for themselves, not for their employers, clients, investors or any organisation they’re involved with. Hosts and guests may hold interests in companies, assets or technologies we discuss. We disclose material interests we know of on the relevant episode page or in the episode itself.
4. Accuracy and corrections
We work to get things right, but the Services may contain errors, go out of date, or include predictions and opinions that turn out to be wrong. We don’t guarantee that any content is accurate, complete or current. When we find a mistake, we correct it and record it in the “What we got wrong” notes on the episode page.
5. Sponsorship and partnerships
Some episodes and newsletters include paid placements. They are always clearly labelled, on air and in writing. Sponsors and partners don’t review, approve or shape our editorial content. A sponsorship is not an endorsement of the sponsor’s products beyond what we say about them.
6. Our content and how you can use it
The episodes, videos, transcripts, articles, artwork, logos and the Big Stakes name are owned by, or licensed to, us and are protected by copyright and trade mark law.
You’re welcome to listen, watch, and share links. You can quote short excerpts or use short clips for commentary, review or news, with credit to Big Stakes and a link back. Please ask us before republishing, redistributing or commercially using anything else, including using our content to train or fine-tune AI models.
7. What you send us
When you send us a question, comment, pitch or idea, you confirm it’s yours to share and give us a free, non-exclusive, worldwide licence to use it on the show, the site and our channels, with credit where appropriate. You keep ownership of it.
Please don’t send confidential information, trade secrets or anything you don’t want discussed publicly. We aren’t obliged to use or respond to submissions. Guest spots are never paid.
8. Acceptable use
When using the Services, you must not:
- break any law, or infringe anyone’s rights;
- send spam, malware, or false, misleading or abusive content through our forms;
- try to get around our security, bot protection or rate limits, including by automating form submissions;
- disrupt, overload or try to gain unauthorised access to the site or its systems;
- scrape or bulk-download content, except through public feeds and search engine crawling that follows our robots.txt.
We may block access or ignore submissions that break these rules.
9. Other sites and platforms
The Services link to, and are distributed through, third-party platforms such as YouTube, Spotify and Apple Podcasts, and to sites we mention. Those platforms have their own terms and privacy policies. We aren’t responsible for their content, availability or practices, and a link isn’t an endorsement.
11. Your consumer rights
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other laws that can’t be excluded. Where the law lets us limit our liability for a breach of a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
12. Limitation of liability
To the extent the law allows, the Services are provided “as is”, and we aren’t liable for any loss or damage, whether direct, indirect or consequential, including financial or investment losses, that comes from using or relying on the Services or anything discussed in them. You’re responsible for your own decisions.
13. Changes
We may update these terms from time to time. The date at the top shows the current version. If you keep using the Services after a change, you accept the updated terms. We may change, pause or stop any part of the Services at any time.
14. Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have non-exclusive jurisdiction. If any part of these terms is found unenforceable, the rest still applies.
